Operating infrastructure

Which suppliers, assets and technology are mandatory?

The unit depends on an accepted indoor facility, an approved pool build and teaching inventory, designated uniform and retail sources, mandatory POS and proprietary digital tools, internet-connected hardware, an accounting system, and the franchisor’s digital Manual and intranet resources.

Facility and aquatic assets

The Accepted Location must be at least 6,000 square feet, cannot be a residential pool and must remain under franchisee control. Floor plans, signs, pool design and upgrades require compliance with franchisor standards.

Required suppliers

Uniforms, teaching equipment and retail products must come from the franchisor, an approved vendor or designated supplier. Alternatives require review of specifications, samples, reputation, credit and delivery.

Pike 13 and digital tools

Pike 13 is required for daily operations reports, cash summaries and the customer database. Proprietary digital tools, the Operations Manual, e-learning and the HUB carry standards and communications.

Local systems

Data access

What does the franchisor control, and what remains with the franchisee?

The franchisor controls the branded operating system and the conditions for using it. The franchisee controls local employment and executes day-to-day operations, but those decisions must stay inside the Manual, approved service menu, territory rules, supplier standards, reporting requirements and inspection regime.

Pricing discretion is not fully allocated. The franchisor may advise on prices and impose promotion-related limits. Current Operations Manual rules and written pricing policies are needed before treating ordinary local pricing as unrestricted.

Market boundaries

How do territory and customer-channel rules work?

A single outlet receives an exclusive Territory around its accepted location, potentially as small as a two-mile radius. That protection limits placement of competing Aqua-Tots outlets, but it does not give the franchisee exclusive control over internet commerce, multi-area programs, alternative channels or every customer residing in the area.

Local Outlet and Territory

The franchisee operates only from the Accepted Location, conducts approved local marketing inside the Territory and generally cannot directly solicit residents outside it without written consent.

Brand and multi-area channels

The franchisor controls brand web pages and may run multi-area or alternative-channel programs. Orders requiring service in the Territory are offered to the franchisee at the franchisor’s established price; declined or unfulfilled orders may be reassigned without compensation.

The MUD Development Area is a separate development right. Compliance with the MUD Schedule blocks another Aqua-Tots outlet in that area, but each unit still needs its own Franchise Agreement and outlet Territory. Missed development obligations can reduce undeveloped rights without eliminating an existing compliant Territory.
