Territory and marketing

What does the franchisor control, and what remains local?

Window Gang, LLC controls the boundaries, brand, channels, approved advertising and data standards; the franchisee controls local staffing, capacity, minimum pricing and day-to-day execution within those rules.

Protected Territory

ZIP codes containing 50,000 to 80,000 single-family dwellings. The territory is protected against another same-brand Window Gang Business while the franchisee complies, but the FDD expressly says it is not exclusive.

Outside-area work

The franchisee may not solicit, advertise or provide Window Gang services outside the Protected Territory without written permission. Out-of-area inquiries must be referred to Window Gang, LLC or the relevant franchisee.

Internet and alternate channels

Franchisee internet advertising requires prior written approval. Window Gang, LLC reserves online, retail, wholesale, mail-order, telephone, television, radio and other alternative channels inside or outside the Protected Territory.

Local advertising

The franchisee must spend at least the greater of $5,000 or 10% of monthly Gross Sales, document the spend, use approved media and submit new materials at least 14 days before use. The franchisor can direct channels, vendors and campaign types.

The official consumer FAQ states that monthly, quarterly and seasonal recurring schedules are available. The contractual service menu and customer communications remain subject to the Brand Standards Manual and approved systems.

Marketing language describing an “exclusive” market does not replace the contract. Item 12 and Franchise Agreement Section 2 provide same-brand placement protection but reserve National Accounts, competitive concepts, alternative distribution and other franchisor activities.
