Territory and channels
What protection does the Franchise Area provide?
The FDD grants an exclusive right to have a location within a ZIP-code-defined Franchise Area of at least 500,000 people. That wording is narrower than an unrestricted exclusive right to every customer, account or channel inside the geography.
No other franchisee may physically locate its office in the licensed Franchise Area, and territorial rights are not conditioned on a sales quota. However, the franchisee should not solicit outside the area through internet, catalog, telemarketing or other direct marketing; online-directory placement requires approval; SystemForward America, LLC may manipulate service-area mapping; and an out-of-area request should be redirected to the brand website or the appropriate TemperaturePro Franchise.
Regional and National Accounts Programs create a separate channel. The franchisee must accept assigned requests, while the franchisor controls national-account relationships and may assign work in unfranchised areas to an existing TemperaturePro Franchise or a non-franchised provider. The Franchise Agreement also reserves intervention rights when an Authorized Service is not being adequately provided or is not being offered.
Do not equate “exclusive Franchise Area” with exclusive ownership of all local leads. The legal protection centers on the authorized location and defined geography, while program accounts, approved channels, service availability, mapping and franchisee compliance create operational exceptions.

Item 20 reports 22 outlets at December 31, 2025: 21 franchised and one company-owned. The total was 26 at both the 2023 and 2024 year-ends, so the disclosed system contracted by four net outlets during 2025.

Item 20, Table 3 reports two franchised openings and six outlets that ceased operations for “other reasons” in 2025, with no listed terminations, non-renewals or franchisor reacquisitions. Table 2 reports no transfers in 2025. These counts describe outlet status, not customer demand, unit economics or owner earnings.
The same FDD states in its cover and Item 1 that SystemForward America, LLC does not offer company-owned businesses, yet Item 20 reports one company-owned outlet in Louisiana for 2023–2025. The article does not resolve that internal inconsistency; a buyer should ask whether the outlet is franchisor-owned, affiliate-owned, legacy, misclassified or otherwise outside the current offer.
